Connecting the dots on the National Defense Authorization Act November 29, 2011 By Director By Douglas J. Hagmann

It was a year ago last week that I warned that the Department of Homeland Security was making a list of U.S. citizens who protested and urged others to protest TSA policies. I disclosed the existence of a written directive issued through DHS Secretary Janet Napolitano and TSA head John Pistole, both acting on behalf of the Obama administration, instructed TSA officials to collect the names and other relevant information of anyone who interfered with enhanced TSA screening procedures by speaking out against them. They were to be classified as domestic extremists in this data mining operation. For my assertions here and on various national news programs, I was attacked by media lapdogs, investigative reporters, and members of both sides of the political spectrum.

Later, my credibility was called into question when an enterprising reporter filed a FOI request and was informed that no such document exits. Case closed. What a surprise.Today, some of the same people who doubted the veracity of the report are suddenly uncomfortable, concerned, or even a bit outraged that the anti-terror apparatus is now turning inward and being set up to be used against U.S. citizens. Again, what a surprise.I am referring to Senate Bill 1867, titled the National Defense Authorization Act (for fiscal year 2012) secretly drafted (in committee) by Senators Carl Levin and John McCain. The bill made it out of committee, sans hearing, and is pending a full senate vote this week.While much of the bill deals with the mundane, sections 1031 and 1032 are raising the concerns of many, including some unlikely allies. In plain speak, those sections of the bill broadly classifies certain U.S. citizens as terrorists, and allow for military intervention against such citizens on U.S. soil.The language of the bill is cumbersome and difficult to assess, thus creating some plausible deniability for those who support this piece of draconian legislation. Representative Justin Amash (D-MI) apparently agrees. According to Rep. Amash, the language of the bill is carefully crafted to mislead the public.

To those who assert that the ambiguity of the bill’s language has been fixed and addressed, he counters that it [still] does not preclude U.S. citizens from being detained indefinitely, without charge or trial, it simply makes such detention discretionary.I contacted my intelligence source who possessed the written directive that was the subject of contentious ridicule for insight into the current activities of our national security apparatus and assessment of the proposed NDAA. According to this source, the DHS is broadening their attention to include anyone who is or will be engaged or encouraging domestic unrest, whatever the reason. The net is being cast over such groups as the Tea Party, which has been under actual and electronic surveillance by the FBI and other intelligence agencies, as well as the various occupy groups.Additionally and perhaps most ominous is that according to my source, active measures are now being taken in the event of bank holidays, closures and associated unrest.Connect the dots. Look at who this bill will ultimately benefit and protect, and who it is intended to stifle. Follow the money, or what’s left of it, before it disappears.

A UK tale of health care and airport scanners

London, England - A new report out by the Equality and Human Rights Commission has thrown a light on the abuses that invariably come when you socialise healthcare. This one focused on home care for the elderly run by local councils. The chronic disregard of pensioners was found to be so appalling many have been left wanting to die. Of the 500k people that are under government care, 250k experienced horrendous neglect. Here are some examples of what carers get up to:
-Refusal to heat food in a microwave and serve due to health and safety concerns
-Soiled sheets unchanged for weeks
-The frail put to bed at 2:45pm
-Lack of time to carry out vital tasks like washing and dressing
-Physical abuse such as rough handling and shouting
-Systematic theft of money
-Leaving food out for a blind and deaf man and not telling him where it is

And it is no better in hospitals, where a study earlier this year exposed similar abuses, like leaving food out of reach, so that patients starved and were so thirsty they couldn’t cry out for help. Hot off the press yesterday, we learn that botched operations are now in the tens of thousands each year, post-operative infections are at an all time high and the death rate due to NHS care is ‘alarmingly high’.

Some elderly with means are even hiring private nurses and having them pose as friends and relatives to ensure they are bathed and fed while in hospital. It is so surreally absurd and obscene, it almost sounds like a comedy sketch, but sadly it is all too real and the tragic result of a human rights culture. And it will be the fate of America if Obamacare is not repealed.When left to the devises of man, a right becomes a politicised tool to manipulate for purposes of greed, power or some other nefarious intent. When passed into law, personal responsibility is abrogated and it is left to the courts to fight out whether a right has been denied based on evidence gathered.Take the simple concept of clean drinking water which the UN Human Rights Council says should be a right recognised under international law. Now since we can’t live without it for more than a few days and we all support that everyone should have it, wouldn’t this be a reasonable law? No it would not. Just because we call something a ‘right’ does not make it so. The thinking gets muddled when we fail to distinguish the difference between a right and a necessity. Water is necessary to human life, so our governments should ensure their citizens have access to it. Unfortunately some governments fail to do so as in developing nations where water access is unsafe or scarce. In 2003 Kerala, India suffered extreme water shortages when corrupt officials granted water rights to a foreign soft drinks manufacturer allowing them to extract a million gallons a day. To combat this kind of poor government judgment, the UN resolution seeks to let the responsibility fall to the international community, which usually means taxing richer nations to supply that water in various programs. But much of that money will inevitably end up funding a new Mercedes or palatial residence for the local despot. The status quo remains as the tyranny of taxation hampers the ability of private sector initiatives to take action.

It’s the same with health care. In Europe no politician will renounce social health care for fear of losing his votes. In fact the best way to gain votes is to denounce its privatization. Money continues to be thrown at services no longer fit for purpose and when that’s gone, the inevitable efficiency cuts come.Billions have been spent here in the UK on commissions and reports by outside agencies producing endless reports on how to fix the NHS. Many point to competition being a key to improvement. Yet the country remains frozen into non-action over this sacred cow because of our deeply imbedded rights culture. Even Socialist Sweden was able to lift itself from health care hell into market led reforms that have transformed their health service. In former communist Slovakia nearly half of health care is privately serviced.The British clearly haven’t suffered enough yet, as they cling to the proposition that universal health care is a right and proper way to equalize resources and makes society fair for everyone. In the process, free market principles are obliterated forcing people who want other non-government alternatives to fund them themselves while still paying tax to for a universal system. And the basic human interaction of one person helping another in need through the choice that a well developed conscience dictates, is replaced by the state and bureaucratic decisions based on statistics and budgets. Taxation and the appeal to our innate sense of fairness is the oxygen that feeds this system, and it inhibits the freedom for civil society to take action because money is squeezed from that sector. And when a right is designated to another party to administer, the culture gets lazy about doing the decent thing. Need can only be truly addressed on an individual basis by people whose objectives are driven by personal charity and not personal greed or power.

Rights culture turns into tyranny when we fillet out moral virtue and conscience. When you leave the judgement of decent behaviour to another – a politician, a court or a human rights commission, you set up a value system that encourages self-centred thinking devoid of personal responsibility. Western civilization was built on Christian values and its attendant rule of law based on Mosaic Law or the Ten Commandants - the ultimate guideline for personal responsibility. Follow these and you have moral order which in turn leads to societal order. Honour your father and your mother, takes care of our elders. If you can’t, then someone in your family will and if they can’t, then it falls to our neighbours, which is way the Christian moral ethic operates. If we swept out government intervention tomorrow, civil society would pick up the baton. Faith groups and others would set up homes for the elderly where volunteers, religious and others would band together supported by private fundraising to do what a culture powered by love does. We see this ethic in operation time after time, especially in America after natural disasters. People pitch in and help their neighbour.America’s founding made this culture of love endemic and is the reason why so many want to flee to its shores, many of whom don’t even understand why this principle works, but they do get that the freedom it spawns does work. The founding fathers also knew the role of government must be to protect this freedom out of which personal responsibility flourishes. This was all placed under God in the Declaration of Independence which recognized the fundamental rights of life, liberty and pursuit of happiness.The culture of rights claims to protect, but it can never succeed. Firstly, take God out of the equation and we will never agree on what a right is. It becomes a euphemism for decency. Bloated on luxurious budgets at the expense of ordinary people, the EU unceasingly dreams up new goodies to throw into the rights bag, as we saw this summer with one member putting forward a bill for the right to a summer holiday.

Secondly, where one right is enforced, another will be violated. Take airport scanners. In the UK we will soon be required to do a full body scan without a pat down option if a passenger is selected for screening. If we refuse, we lose our right to fly. Flying is not a right, but in a free society a bought service. We choose this service based on how safe they make it, the food, seat comfort, etc. The individual airlines in turn should be able to provide the necessary security as they see fit.Decency dictates that appearing nude to a stranger while being bombarded with ionizing radiation would warrant another method more valid. But despite the unusual move by the EU to direct its member states not to use this type of scanner, the UK is going ahead because of the significant terror threats we face and our rights be damned.In a free society airlines should be able to choose their methods of security and market them accordingly. Israeli airline EL AL would be the first port of call for consultation as they have cornered the market in determining who poses a threat by psychological profiling, suspect terrorist intelligence and good old fashioned common sense backed by gun wielding marshals on board. Now that’s a service I would gladly pay for and relax on the flight.And the rest who still feel violated? Since the majority of terrorists taking to the skies these days are Islamofacists, we could create flights based on Imam-defined rules of safety where Muslims might feel happier about not being profiled. The market would operate freely, we all have our dignity and rights intact and we would see who did the better business. Similarly, a free market health care system weeds out the good hospitals from the bad and the impetus to decency of the individual would see to the needs of the truly destitute.

The Mexican-American border is more than the Rio Grande or a fence in the desert; it’s a mobile frontier where cultures have struggled for centuries. Forces of mayhem are currently dominant because governments on both sides don’t care, don’t appreciate the terror or are making money off the situation.Politicians don’t understand that this is more than a debate point during election season; it’s an active international disaster that threatens national security.America must defeat major criminal forces and provide a firm, regulated path for international exchange with Latin America or we will lose this war; those forces will overtake us. Our rule of law will end and their rule of man will dominate as it does in most of Latin America.The border is inherently unstable. Americans go there for entertainment illegal at home, thinking Mexico has no laws; Mexicans cross to America thinking the same thing. It’s common for families on both sides to recover their relatives from foreign jails.A vast criminal economy thrives on this reputation, reaching far beyond the obvious sins into corrupt officials and milking social services. Armies of gang soldiers fight wars over money, soldiers as devoted to their cause as any American military hero. They only know force; the physical border means little to them.When not stopped at the border they reach up into America and everyone feels the danger, the insecurity. Americans used to feel it when they visited border towns then feel secure upon return—now it’s much farther north.

We discuss it, a strong, invisible sensation affecting us all alike. It isn’t cultural prejudice. Friends from Mexico say it’s stronger for them, a sense of being subject to the whims of local strongmen, of not having a set of laws to protect them. It drives them to emigrate to AmericaThe American rule of law attracts people of little opportunity from deep in Latin America. At home, they cannot attain the security afforded the general American public, and so they come, danger increasing as they approach the border.Danger also increases as governments and economies weaken. The more desperate people, the more criminals there are to prey on them. When governments turn their back predators pounce. Conditions are worsening.In places the sense of security has extended into Mexico. Algodones, on the Colorado River across from Yuma, easily accessible from California, has been a haven for Americans for many years. Kept absolutely safe by Mexican authorities, retirees wintering in the area shop, dine, and meet all their medical needs in complete security.Cannon balls have flown over the Rio Grande at the south tip of Texas but usually they are at peace. Now, however, as in all border towns, you cross into Mexico at your own risk; the nature of the border changes.Ojinaga was our regional secret for years. Far from other border towns, it escaped the usual filth. It felt like a Mexican city far below the border, safe, beautiful and friendly, right on the Rio Grande.

Today, Ojinagans with family on both sides of the river advise not to visit. Rural areas are safe but the city is insecure. What a tragedy. This tears at the heart of Mexico and at the hearts of all who love Mexican culture.

The El Paso area is fascinating, unique in its cooperation between authorities. Two national governments are involved, two American states, one Mexican state, El Paso County, two American cities (El Paso and Las Cruces, NM) and several municipalities and colonias. They have a vast reservoir of border knowledge, of solving problems, yet who is going to those functionaries and gathering information? Corruption in Texas has made the American side of the border so insecure at times that Texans moved to Mexico. When Ma Ferguson was elected governor in 1933, famed Texas Ranger Frank Hamer quit the Rangers in disgust and rode with the Rurales in Mexico.Anglos were first drawn to Texas by freedoms afforded under the Mexican Constitution of 1824. That’s why 1824 was on the Alamo flag. They rebelled against the dictator Santa Anna, not against Mexico, because he had rescinded that Constitution.Before Santa Anna marched north, the line between the rule of law and the rule of man was about two hundred miles south of the current border, below Monterrey and Saltillo. Northern Mexico is still culturally and politically distinct from Central Mexico, more conservative and business oriented.With Santa Anna’s defeat at San Jacinto in 1836, the line retreated to the Rio Grande according to Texans, to the Nueces River according to Mexicans, and the land between those rivers became a war zone for decades, finally secured for the United States through force of arms.Border power fluctuates along the highway from Southern California to San Felipe in Mexico, on the Gulf of California. It’s a gold mine for Mexican traffic cops.The highway also runs north from Mexico to almost unlimited work in the Imperial Valley.When Mexican cops put too much pressure on tourists going to San Felipe, American cops put the hammer on Mexicans headed north to work. After a few days everyone backs off and the cycle starts over.

The border might be a designated line but it’s actually malleable, a perception of authority. The powers of evil pace themselves to our government’s varying level of concern, like Ho Chi Minh manipulating President Johnson, and they will win using the same tactic.North American civilization is gradually eroding, as in the current discussion of resident tuition rates for long-term illegal aliens. Even conservative politicians are confused, willing to negate Federal Law to avoid the discussion.
Decision makers accept facts as fed to them and agree to pass the buck, ignoring standard methods of determining justice: contrasting people’s behaviors under like circumstances.A significant body of illegal alien students foresee the residency problem and resolve it before they apply to college. We never hear of them because they come from self-reliant families, hard-working people, the best of the American dream. Mexico might someday save America from moral and economic collapse because of these people.Should the system be changed? No. Illegal alien students should take care of their residency status ahead of time, like their peers. This is not a government problem; it’s an individual problem, but no politicians on the federal level are willing to take the risk to say so.If politicians ignore the law to accommodate noncompliance more exceptions will be sought—mayhem will increase.
Enemies of civilization encourage whining because it unsettles incompetent authority, benefits the forces of evil. The corny phrase forces of evil applies here—come visit.To cease suffering, just as to cease war, there is no substitute for victory. Are our leaders willing to step up to the task? Stabilizing the border will take a firm hand.

New U.S.-Canada border plan raises privacy concerns

Canada's new border action plan will feature a new entry-exit control system that will allow the United States to track everyone coming and leaving Canada by air, land and sea, CTV News has confirmed.The new, 32-point border action plan will be signed by Prime Minister Stephen Harper and U.S. President Barack Obama when the pair meet at the White House in Washington next week.But despite concerns about privacy stemming from personal information that will be shared with American authorities, the federal government insists there is little to worry about.When I go to the United States today, you have to provide your home, your birth date, your passport information, your travel information, said Foreign Affairs Minister John Baird. Whenever we look at security, we keep in mind privacy concerns are tremendously important to Canadians, and that's something we feel very strongly about.But the office of the privacy commissioner has already pointed out that that the federal government has yet to share any details of the new border rules.In past public comments, Privacy Commissioner Jennifer Stoddart has made it clear that Canadian sovereignty and privacy rights must be protected.

Rather than jumping into a newly defined relationship with both feet, we should only do so with both eyes wide open, Stoddart wrote on her blog recently.In exchange for more information about travelers crossing the border from Canada, Washington has responded to a chief Canadian gripe about cross-border traffic: gridlock.Along with security, parts of the new border plan will focus on trade, including pre-screening stations set up on Canadian territory, meaning less congestion at the actual border crossing.The problem today is that we have bottlenecks at the border, said Perrin Beatty, president of the Canadian Chamber of Commerce. You have low-risk cargo, low-risk passengers crossing the border at the same time as high-risk.Beatty said that the new plan will allow Canada and the U.S. to focus resources where it's needed the most.Under the terms of the new deal, the U.S. will move to cut down on traffic at border crossings and allow pre-screenings on certain low-risk cargo trucks. IN an effort to speed the process, U.S. officials will only flag suspicious vehicles at the border rather than doing full inspections that hold up other passengers and cargo.

According to Birgit Matthiesen, from the trade association Canadian Manufacturers and Exporters, doing so will be good for the bottom line in both countries.But the 32-point plan also features more than just new border-crossing protocols.In fact, both nations plan to streamline and harmonize regulations in the automotive and food sectors.According to Beatty, the new rules are the result of the integrated nature of the continental economy.In particular, Ottawa has already quietly prepared regulations to adopt U.S. crash-testing standards for seat belts and built-in child booster seats.According to Matthiesen, the harmonized regulations will ensure that business is better integrated on both sides of the border.It will save both Canadian companies, and their U.S. buyers in a highly integrated supply chain, millions of dollars, she said.Some features of the beyond the border plan could be in place within months. CTV reports, A new, 32-point border action plan will be signed by Prime Minister Stephen Harper and U.S. President Barack Obama when the pair meet at the White House in Washington next week. It’s expected this will be December 6 or 7. According to the CTV report:

1-Canada’s new border action plan will feature a new entry-exit control system that will allow the United States to track everyone coming and leaving Canada by air, land and sea… The office of the privacy commissioner has already pointed out that that the federal government has yet to share any details of the new border rules.

2-Parts of the new border plan will focus on trade, including pre-screening stations set up on Canadian territory… The U.S. will allow pre-screenings on certain low-risk cargo trucks. In an effort to speed the process, U.S. officials will only flag suspicious vehicles at the border rather than doing full inspections that hold up other passengers and cargo.

3-Both nations plan to streamline and harmonize regulations in the automotive and food sectors (recognizing) the integrated nature of the continental economy. In particular, Ottawa has already quietly prepared regulations to adopt U.S. crash-testing standards for seat belts and built-in child booster seats.

Yesterday, Globe and Mail columnist John Ibbitson wrote that the plan will include:

1-A new entry-exit system that will track everyone coming into or leaving Canada by land, sea or air. …(This) will enable the federal government to, among other things, ensure that landed immigrants are actually living in Canada. …Many will balk at the iris scans or other biometric measures that doubtless will come with the new entry-exit controls…

2-It will harmonize a plethora of regulations and safety standards in the automobile, food and other industries.

3-It will make it easier to obtain temporary work permits and a trusted-traveller document that will allow frequent crossers to skip the lineup at Customs.

4-Air, land and maritime inspections will be more fully integrated…
5-Both sides will be able to more easily detect and deter cyber threats.

What kind of regulatory alignment might we expect to see as a result of the Beyond the Border action plan? In April, Macleans magazine reported that the Beyond the Border consultation in the United States submission have been received from, Target Corp. …who bemoan conflicting regulations between the US and Canada in areas such as product standards, testing facilities, customs procedures and documentation; …the biotechnology industry association asked that both countries adopt consistent science-based processes that would significantly decrease the time required for authorization of biotech crops and their products; …several US agricultural groups asked for harmonization of the maximum permissible pesticide residue levels for produce; (and) the US Chamber of Commerce…suggested examining wherever possible what can be done to align health care regulatory frameworks between the US and Canada for medical devices and pharmaceuticals. In September, Bloomberg reported, Proposals in the auto industry would implement common rules for safety and emissions standards. Cooperation on energy may lead to a ‘Canada-U.S. regime for permitting oil-and-gas pipelines,’ the report said. Canada’s customs agency said in June it is looking at ways to speed inspection of food products that are imported by companies that qualify as posing little risk.

An Ipsos-Reid poll conducted in February 2011 found that, 91 per cent of Canadians say the negotiations (on perimeter security) should take place in public so that they can see what is on the table. …Canadians want Harper to adopt a much more transparent approach to the…negotiations which are being held in total secrecy.The poll also showed that, (68 per cent) of Canadians fear Prime Minister Stephen Harper will compromise by giving up too much power over immigration, privacy and security to get a deal with the United States on border controls…

Paul Martin’s Liberal government unveils Canada’s first-ever national security policy, called Securing an Open Society, which is aimed at responding to the new threat environment through a coordinated approach with other key partners – provinces, territories, communities, the private sector and allies.While building on the Smart Border Declaration with the United States, the new security policy contains many elements that will end up in the Security and Prosperity Partnership, including increased cross-border cooperation on intelligence, pandemic preparedness and transportation security.

Bush’s first visit to Canada, then Prime Minister Paul Martin gives birth to the SPP by issuing a joint statement on common security and prosperity called, A new partnership in North America. Security priorities include: improving the coordination of intelligence-sharing, cross-border law enforcement and counter-terrorism; … increasing the security of critical infrastructure, including transportation, energy, and communications networks, and to, pursue joint approaches to partnerships, consensus standards, and smarter regulations that result in greater efficiency and competitiveness, while enhancing the health and safety of our citizens.

The Council of Canadians releases leaked minutes from an October 2004 Task Force on the Future of North America meeting that describe bulk water exports as a politically hot long term goal of integration that should be broached at a later date. Also being discussed by the task force are: eliminating current NAFTA exemptions for culture; crafting a North American resource pact that would allow for greater intra-regional trade and investment in certain non-renewable natural resources, such as oil, gas, and fresh water; and a North American brand name to portray North America as a sort of club of privileged members. There are also plans to encourage a North American identity among students in all three countries.

The Independent Task Force on the Future of North America releases a preliminary report, calling for the creation of a North American economic and security community by 2010. Although it didn’t include controversial hot suggestions, such as a water-sharing agreement, among the report’s key recommendations are the establishment of a continental security perimeter, a common external tariff, a common border pass for all North Americans, a North American energy and natural resources strategy, and an annual meeting where North American leaders can discuss steps toward economic and security integration.

At a meeting in Waco, Texas, George W. Bush, Paul Martin and Vicente Fox issue a joint statement announcing the creation of the Security and Prosperity Partnership of North America. The tri-national agreement, which essentially brings Mexico into the Canada-U.S. partnership announced in November 2004, contains almost all of the recommendations on continental economic and security integration proposed by the Independent Task Force and the CCCE’s Security and Prosperity Initiative before it.

The first North American Forum brings together U.S., Canadian and Mexican government and business representatives to discuss issues related to continental economic and social integration; it is held at a secret location in Sonoma, California. Invitees include John Manley, Mexican ambassador to the U.S. Carlos de Icaza, Chevron CEO David O’Reilly, former head of the CIA James Woolsey, and a host of U.S. policy advisors to George W. Bush. The Council of the Americas, United Postal Service and the North American Business Committee host a Public-Private Sector Dialogue on the Security and Prosperity Partnership of North America in Louisville, Kentucky. The meeting is attended by 50 government officials and business leaders from Canada, the U.S. and Mexico, including members of the Canadian Privy Council Office, the Mexican Presidency, the U.S. Department of Homeland Security and corporate reps from ExxonMobil, DaimlerChrysler, Ford, Tyco, and FedEx. Attendees discussed marrying policy issues with business priorities, musing that, leadership from governments that recognizes the importance of business issues to the overall social welfare empowers the private sector to engage substantively and pragmatically on trade and security issues without undue deference to political sensibilities.A North American Competitiveness Council to drive the SPP process is proposed.

At the second SPP summit in Cancun, Mexico, President Bush, Prime Minister Stephen Harper and then Mexican President Vicente Fox announce the creation of the North American Competitiveness Council (NACC). This corporate working group is charged with directing the SPP process and includes at least 10 CEOs from each country, including representatives from Lockheed Martin, Wal-Mart, General Motors, Home Depot Canada, Canfor and Suncor.

June 15, 2006
The NACC is officially launched at a joint press conference held by U.S. Secretary of Commerce Carlos Gutierrez, Mexican Economy Minister Sergio Garcia de Alba and Canadian Industry Minister Maxime Bernier. According to a report from the Council of the Americas, the purpose of institutionalizing the North American business community's involvement in the SPP process was so that the work will continue through changes in administrations. Furthermore, the NACC is to make sure that, governments look to the private sector to tell them what needs to be done. According to a Canadian government press release, the NACC has a mandate to provide governments with recommendations on broad issues such as border facilitation and regulation, as well as the competitiveness of key sectors including automotive, transportation, manufacturing and services.

The NACC meets in Washington, D.C. to hash out priority issues for the SPP. The business leaders decide that the U.S. members will deal with regulatory convergence, the Canadians will handle border facilitation, and the Mexican members will devise a plan for energy integration.

September 12-14, 2006
The North American Forum meets for the second time, in Banff, Alberta, this time to discuss demographic and social dimensions of North American integration, security cooperation, and a North American energy strategy. Once again, the meeting is kept secret, despite the involvement of high-ranking military officials, politicians and top bureaucrats – including Stockwell Day, who refuses to disclose the content of his speech to the media.

The Harper government releases a financial outlook document called Advantage Canada: Building a Strong Economy for Canadians. Advantage Canada praises the SPP effort to seek regulatory convergence on border security. It also indicates that the federal government is working with the provinces to speed up and streamline the environmental assessment process, particularly as it affects cross-border infrastructure projects. Furthermore, Advantage Canada emphasizes the importance of huge trade corridors to the economic wellbeing of the country, and looks to the private sector to help with all new infrastructure projects. For its part, Canada’s New Government intends to establish a federal P3 office that will facilitate a broader use of P3s in Canadian infrastructure projects,says the document.The Government will also encourage the development and use of P3 best practices by requiring that P3s be given consideration in larger infrastructure investments that receive federal program funding.Under the SPP’s transportation agenda is an initiative to examine the benefits of an intermodal transportation concept for north America,the goal being to move foreign goods, mostly from Asia, quickly through North America to key markets in the United States.

Former industry minister Maxime Bernier and Public Safety Minister Stockwell Day join a handful of deputy ministers and government policy advisors at a dinner meeting in Ottawa with members of the NACC and CCCE, including Tom d’Aquino. According to information acquired by the NDP, the goal of the meeting was to provide an opportunity, for Canadian members to regroup and focus their planning in advance of the February 23, 2007 SPP ministerial meeting, also in Ottawa.

SPP ministers, including Maxime Bernier, David Emerson, Stockwell Day, and their U.S. counterparts Michael Chertoff and Carlos Gutierrez, meet with the NACC to discuss the progress of the integration agenda. The NACC releases a report containing 51 recommendations, including: Complete negotiations, sign a new North American Regulatory Cooperation Framework in 2007, and ensure consistent application of standards and regulatory requirements within each country. The corporate body suggests that, upon signature of the framework, a North American Regulatory Cooperation and Standards Committee, which includes the private sector, should be formed to survey on a regular basis the variety of standards and regulatory differences by industry that impede trade and seek to reduce the identified differences or develop other mechanisms to lessen their impact on the competitiveness of North American industry.

The Conservative government releases its 2007 budget – Aspire to a Stronger, Safer, Better Canada – in which it promises to improve Canada’s regulatory framework by moving to finalize a new modern approach to smart regulation, and by working with the United States and Mexico through the Security and Prosperity Partnership of North America to improve regulatory coordination and cooperation. At the heart of the government’s strategy is the adoption of a new Cabinet Directive on Streamlining Regulation that will come into effect on April 1, 2007. Budget 2007 provides $9 million over two years to implement this initiative.

The Government of Canada’s new Cabinet Directive on Streamlining Regulation comes into effect, requiring that all government departments take into consideration the “cost or savings to government, business, or Canadians and the potential impact on the Canadian economy and its international competitiveness,” as well as the “potential impact on other federal departments or agencies, other governments in Canada, or on Canada's foreign affairs” before moving ahead with new rules on everything from food and drugs to pesticides to the environment and public health. The directive moves regulation in Canada further away from the precautionary principle and more in line with the U.S. focus on risk assessment and voluntary compliance.

Leaked documents acquired by the Council of Canadians reveal that bulk water exports from Canada to the United States are in fact being discussed in relation to the SPP. The North American Future 2025 Project, which is led by the U.S.-based Center for Strategic and International Studies, the Conference Board of Canada and the Mexican Centro de Investigación y Docencia Económicas, involves a series of closed-door meetings on North American integration dealing with a number of highly contentious issues including bulk water exports, a joint security perimeter and a continental resource pact.

North American transport ministers, including Conservative MP Lawrence Cannon, meet in Arizona for an SPP meeting, in order to confirm and advance our commitment to developing coordinated, compatible and interconnected national transportation systems. Developing an intermodal transportation concept for North America is an SPP initiative. A key milestones under that initiative commits transport ministers to, work toward establishing an intermodal corridor work plan and a Memorandum of Cooperation pilot project. The Arizona meeting, which the ministers describe as the first in a series, appears to be the beginning of this pilot project.

CanWest News Service reports that Canada is set to raise its limits on pesticide residues on fruit and vegetables as part of an effort to harmonize Canadian pesticide rules with those of the United States, which allows higher residue levels for 40 per cent of the pesticides it regulates. According to the article, which appeared in papers across the country, the effort is being fast-tracked as an initiative under the Security and Prosperity Partnership (SPP), a wide-ranging plan to streamline regulatory and security protocols across North America. The article proves that regulatory harmonization as spelled out in NAFTA and the SPP puts downward pressure on regulations and that higher standards are rarely if ever mutually adopted between harmonizing parties.

Conservative MPs storm out of parliamentary hearings into the SPP after the Tory chair of the Commons Standing Committee on International Trade interrupts a presentation from Council of Canadians board member Gordon Laxer linking the SPP to tar sands production. Committee chair Leon Benoit can’t see the link between the SPP and energy security for Canada, despite energy integration being a key priority of the SPP and of the NACC. The meeting continues after all but one Conservative MP leaves the room.

Former industry minister Maxime Bernier, along with his chief of staff and several other policy advisors, meets with the three national NACC secretariats at the Americas Competitiveness Forum in Atlanta, Georgia. According to information acquired by the NDP, the minister received feedback on the NACC’s recommendations and heard its next steps.

Transport Canada’s no-fly list, called Passenger Protect, comes into effect. Airlines begin checking passenger names against a list of people deemed so dangerous to the flight that they should not be allowed to board. Passengers who appear on the list may appeal mistakes to an office of reconsideration. Security experts agree that Canada’s list will inevitably merge with the much larger U.S. no-fly list – a key priority of the SPP’s security agenda. Canada’s airlines have already been using the U.S. list, which contains almost 500,000 names, and news reports from late May 2007 indicate they will continue to rely on it rather than Passenger Protect.

Topics for discussion include expectations for [the] North American Leaders’ Summit and Canadian priorities, the role of the NACC, and an update on the Prime Minister’s recent visit to Latin America.

In a sure sign that opposition to the SPP is making an impact, the Liberal party releases a report called, Strong and Free: The Liberal Blueprint for the North American Leaders Summit at Montebello, Quebec. The report incorporates the Council of Canadians’ demands on the SPP, including disclosing the complete list of SPP working groups, their contact persons and participating membership [and] requiring them to provide opportunities for public input. Liberal party leader Stephane Dion promises, Should the Prime Minister fail to level with Canadians, we will table a resolution calling on the government to inform Canadians of the work and negotiations of the SPP, and to report to the House of Commons to allow for parliamentary scrutiny and a full and informed debate when the Parliament reconvenes.

August 19, 2007
Thousands of people take to the streets of Ottawa to protest the SPP on the eve of the third annual Leaders Summit taking place the following day in Montebello, Quebec. According to later reports by the CBC, the Ottawa Police Service spent $3.7 million on security for the day. Following the protest, the Council of Canadians brings hundreds of people together at a public forum at the University of Ottawa where they hear about deep integration from civil society representatives from Canada, the U.S. and Mexico, as well as from representatives of all four major opposition parties.

August 20, 2007
Like the day before, thousands of protesters head to Montebello where they confront almost as many police officers surrounding the Fairmont hotel where Prime Minister Harper is meeting with Presidents Bush and Calderón. News reports several weeks later peg security costs for the Quebec police force alone at over $7 million. Harper refers to the gathering outside as sad, while CCCE President Tom d’Aquino likens the protesters to barbarians at the gates. I do not say to myself, If I don’t get an hour with the prime minister in the next six months, I’m going to go out and protest and reject the system outright,he tells CBC News. I don’t do that because civilized human beings – those who believe in democracy – don’t do that. Later that night, d’Aquino and the CCCE spend another hour or two with Industry Minister Jim Prentice, Finance Minister Jim Flaherty and Bank of Canada Governor David Dodge, as well as several other deputy ministers, foreign officials and NACC members, at a dinner in Ottawa, according to information obtained by the NDP. Council of Canadians activist and filmmaker Paul Manley posts a video of the day’s events on YouTube that depicts what look like three rock-wielding undercover police officers – agents provocateurs – in the crowd.

The third annual SPP Leaders Summit wraps up in Montebello with a joint statement by Prime Minister Harper on progress and next steps. But the headlines are about the YouTube video depicting agents provocateurs. (The Quebec police force at first denies that there were undercover agents then admits it in an embarrassing flip-flop.) Harper makes light of the protests by claiming the leaders were discussing jellybeans, while at the same time he announces four major new SPP developments: an Intellectual Property Action Plan; the long-anticipated (by the business community) Regulatory Cooperation Framework; a North American Plan for Avian and Pandemic Influenza; and a treaty-level Agreement for Cooperation in Energy Science and Technology. The Canadian Centre for Policy Alternatives will later release a report on regulatory harmonization with the United States in which it notes that a side-agreement – Regulatory Cooperation in the Area of Chemicals – that appears on the U.S. SPP website was not announced by the Canadian government.

The third annual North American Forum takes place in Puerto Vallarta, Mexico. Like previous years, the guest list and agenda were kept secret but the Canadian Labour Congress receives a copy of the latter. According to the leaked agenda, this year’s forum was called, North American Cooperation and Community.Leonard Edwards, deputy minister of foreign affairs, moderated a session on the Strategic dimensions of the North American security and prosperity partnerships, while Tom d’Aquino spoke on a panel addressing the topic, Investing in competitiveness: new ideas and options for infrastructure, borders and business – Public/private partnerships, municipal bonds and border development.

The Munk Centre’s Project on Water Issues releases a report by Andrew Nikiforuk called, On the Table: Water, Energy and North American Integration. Confirming repeated statements by the Council of Canadians, the report states that: There is now a formal framework for discussing Canada’s water as a trade item – the Security and Prosperity Partnership (SPP) – which met most recently in August 2007 at Montebello, Quebec… While this summit focused publicly on other continent-wide issues, the concept of trade in water has remained quietly but persistently present under the larger banner of trade relations.

A Federal Court judge rules that Canada must reconsider the Safe Third Country Agreement it signed with the United States in 2004, because, Washington flouts conventions meant to safeguard immigrants against torture in their homelands, according to a Globe and Mail article. The Safe Third Country agreement was a cornerstone of the Smart Border Declaration of 2001 and a major component of the plan to harmonize refugee and immigration policies. The court gives both parties (the Government of Canada and the Canadian Council for Refugees) until January 14 to make and respond to submissions for an appeal.

January 22, 2008
British Columbia becomes the first province to offer an enhanced driver’s licence compatible with licences in Washington State to meet new U.S. security demands amidst widespread public concern with the new technology. Canada’s Federal Privacy Commissioner slams the cards as tamper-prone and unnecessary. RFID technology would make it possible for governments to track individuals carrying enhanced driver’s licenses and access personal information stored on the card, she says in a subsequent press release. The new licence, which requires the sharing and storing of citizenship and other personal information with U.S. authorities, has the potential to become a de facto North American ID card through ongoing initiatives of the SPP.

In his final State of the Union address, President Bush announces that the next SPP summit will take place at the end of April in New Orleans. Tonight the armies of compassion continue the march to a new day in the Gulf Coast, said Bush, referring to the record number of charitable and faith-based groups filling in where the U.S. government continues to pull out of social service provision and disaster recovery plans. America honors the strength and resilience of the people of this region. We reaffirm our pledge to help them build stronger and better than before. And tonight I’m pleased to announce that in April we will host this year’s North American Summit of Canada, Mexico, and the United States in the great city of New Orleans. A subsequent White House press release clarifies that the summit will take place April 21 and 22, 2008. The Harper government issues no such press release.

Prime Minister Harper creates a Cabinet Committee on Afghanistan and an Afghanistan Task Force based on recommendations from John Manley’s earlier task force on Canada’s role in the ongoing occupation. At the head of the Cabinet Committee is former Liberal and former Canfor CEO David Emerson – hardly a military expert but very tight with Washington. Emerson, a former vice-chair of the CCCE, has been an SPP minister since the beginning, first as Industry Minister with two previous Liberal governments, then as International Trade Minister with the Conservatives since February 2006. Environment Minister Peter Kent wouldn't confirm or deny Monday that Canada plans to formally withdraw from the Kyoto Protocol, as talks on the accord's future got underway in Durban, South Africa.I won't comment on a speculative report, Kent said in response to questions about a report that Canada will announce it is pulling out shortly before Christmas.But South Africa's high commissioner to Canada said in an interview with CBC News that there has been speculation for weeks about the Conservative government's planned withdrawal and about it wanting other countries to follow suit.

Timeline Canada and Kyoto

It's disturbing and very disapppointing that a country like Canada would pull out after having given leadership in this particular UN convention which is so important for the world, Mohau Pheko said.It will, of course undermine the process going into Durban because obviously they have not only just planned their own withdrawal, which we are speculating upon, but they have actively lobbied other countries to do the same.I think that this is part of what is disturbing as well. That while you hold your own position then withdraw and allow others to continue with the process. So it's a very disappointing position I think that Canada has taken and as I said not only for the world but for Canadians themselves, she added.Pheko said reports about Canada withdrawing don't come as a surprise, given the government's approach to negotiations leading up to the Durban conference.She also said it makes sense for Canada to rally support around its position of withdrawing from the Kytoto protocol, if that is what is announced in the coming weeks.There is speculation that Canada has been lobbying other countries too, of course you don't want to move on your own and be seen as a pariah of the world on climate change, so obviously you may need a few friends to move along with you, she said.Kent was asked several times earlier in the day at a news conference in Ottawa, and opposition parties also pressed him in question period Monday afternoon, to confirm the report about pulling out of Kyoto but he did not give a definitive answer.Kent was making an announcement in Ottawa about continued funding for the Conservative government's clean air agenda – $600 million over the next five years.

The environment minister said that in Durban he will try to convince the other parties that signed the protocol that a new international agreement is needed, one that includes the world's major polluters. He leaves for the two-week conference later this week.We're going to Durban to work in common cause with the other parties to the convention to advance a new climate change agreement, binding eventually, which will engage all emitters in both the developed and the developing countries, Kent said.He called the international agreement one of the biggest blunders the Liberal government ever made and said his government is committed to a realistic plan to reduce greenhouse gas emissions.Kyoto is the past, Copenhagen and Cancun are the future, Kent said, referring to the commitments made at climate change talks in those cities in recent years.Negotiators and political leaders from 190 countries, including Canada, are participating in the conference, and are seeking new ways to cut carbon dioxide emissions and pollution and also trying to resolve differences between rich and poor countries on how to fight climate change.The UN climate secretariat Christiana Figueres said future commitments by industrial countries to slash greenhouse gas emissions is the defining issue of this conference. She is hoping for a decision at the meetings on extending emission reduction commitments under the Kyoto accord. The protocol called on nations to reduce carbon emissions five per cent below 1990 levels by the end of next year and some of the commitments are due to expire next year.

But Meyer said a withdrawal, which would only come into effect next year, would allow Canada to continue to be a negotiator on the future of the protocol watering down the treaty and wrecking the job of the rest of us.Kent said that if climate change is meaningfully going to be addressed, then major emitters of greenhouse gases can't sit on the sidelines, and all countries have to play their part.The underlying division between developing and industrial nations on the future of the protocol has stymied negotiations on where to take it.Poor countries want the industrial nations to commit to more cuts for a second period, saying the protocol is the only legal instrument ever adopted to control carbon and other gases that trap the Earth's heat. But the wealthy countries, with growing consensus, say they cannot carry the burden alone, and want rapidly developing countries like China, India, Brazil and South Africa to join their own legally binding regime to slow their emissions growth and move toward low-carbon economies.

Canada making progress on targets

Kent said Canada has made a commitment to reduce greenhouse gas emissions to 607 megatonnes by 2020 and a sector by sector approach is being taken in alignment with the United States.We are making progress, he said. Kent said Canada has introduced stringent emission standards for some vehicles and that the new funding announced Monday will go towards monitoring and enforcing regulations, and will help identify new air quality issues and to evaluate solutions to emerging and existing issues.
Kent said the government is in the final stage of writing new regulations for the coal-fired electricity industry, the second-largest greenhouse gas emission sector, and have begun consultations with the oilsands, steel, cement, and gas industries.We are moving forward with a very clear and transparent process, said Kent.He estimated that Canada is about a quarter of the way to meeting the 2020 target.We are pursuing, domestically, an honourable approach to meet our international commitments and we are engaging honourably with our partners around the world to come up with a new agreement that will as I said, include all of the major emitting countries, whether they be developed or developing, he said.

Celebrities Angelina Jolie and Bono are expected to make appearances.Diplomats from some 200 countries - including the European Union, a signatory to the convention - will negotiate for nearly two weeks on how to keep temperatures below two degrees Celcius above pre-industrial times (considered vital by scientists).The talks come after mounting reports that carbon levels have reached record highs and temperatures are rising fast. Global greenhouse gas emissions are projected to double in the next 40 years. This would result in a three-six degree increase of the average global temperature by the end of the century unless governments take decisive action,said the Paris-based think-tank, the OECD in a statement last week. Recent UN reports said a warming climate is expected to lead to heavier rainfall, more floods, stronger cyclones and more intense droughts.

For most people in the developing world and Africa, climate change is a matter of life and death, said Jacob Zuma, president of South Africa at the opening ceremony on Monday.The programme is likely to be dominated by the Kyoto protocol, the only legally binding treaty obliging the rich world to cut its greenhouse gas emissions, which expires after 2012.A new, global deal was meant to be concluded two years ago, at the climate conference in Copenhagen in 2009, but failed to materialise. Instead, China and the US, the world's two biggest polluters, issued a non-binding statement, full of loose rhetoric.No binding deal is expected to come out of Durban either. Instead, discussions aim to agree to come to a new deal in the future and - in the meantime - to keeping the Kyoto protocol alive.Big emitters like Russia, Japan and Canada have already said they will not sign up to a second Kyoto period. The US never has and is unlikely to now. It objects to the fact that in the protocol, developing countries are exempt from cutting emissions since it is the developed world which is responsible for the high levels of greenhouse gases in the atmosphere today.The European Union, for its part, has said it will gladly sign up to a second Kyoto period, but only if a road map is agreed upon that will lead to the implementation of another legally binding agreement by 2020.A second Kyoto period with only the EU, representing only 11 percent of global emissions, is clearly not enough,EU climate change commissioner Connie Hedegaard said.

We would only be politically able to move ahead into a second commitment period of the Kyoto Protocol if there is at least a road map forward with others saying when they are going to come into the climate fight, Artur Runge-Metzger, the European Commission’s lead negotiator, noted.For his part, the Durban envoy of the Green group in the European Parliament delegation, said the EU strategy will frustrate talks and render the Union irrelevant.The EU should just say right away that it will sign up for a second Kyoto period, he said.That way, China will not be able to hide behind the argument that the rich world is not willing to cut emissions. Otherwise, the negotiations will end up becoming a trench war between rich and poor, between the US and China. And Europe will be on the sidelines, just like in Copenhagen.

Syrian sources claimed that Russian warships entered Syrian territorial waters last week as a deterrent to any NATO-led assault.

BRUSSELS - The International Monetary Fund (IMF) is preparing a multi-billion-euro rescue of Italy, reports in the Italian media on Sunday (27 November) claim.The Washington-based lender is in talks readying a €600 billion assistance package for Rome in return for swingeing austerity and structural adjustment measures, according to an article in Italian daily La Stampa, quoting unnamed officials in the American capital.Spain meanwhile may not need a full bail-out programme and be offered instead a credit line.Buttressing speculation that the IMF is set to bail out the eurozone’s third biggest economy, ECB member and Bank of France governor Christian Noyer was asked directly by reporters whether the IMF is preparing a programme of support for Italy, but he refused to comment.Italy should not be considered a weak economy, he said, speaking in Tokyo.A breakup of the euro zone is out of the question. There is no plan B.However, an IMF spokesperson has since denied the reports: There are no discussions with the Italian authorities on a programme for IMF financing.According to the Italian newspaper, a range of options is being considered, although the core of the plan would be for the IMF to provide funding to Rome at rates of between four and five percent, considerably lower than the seven percent rates forced upon Italian government borrowing in recent days.

While there has been much muttering in other capitals about what Germany should or should not be doing, Poland is the first to come right out and say it aloud.The Polish minister hit back at the dominant political discourse in Germany, which has focussed on the country's budgetary discipline compared to profligate southern countries as well as the potential extra burden to German taxpayers of mutualising eurozone debt.We ask that Germany admits that she is the biggest beneficiary of the current arrangements and therefore that she has the biggest obligation to make them sustainable, said Sikorski, adding that because investors are shunning riskier countries Berlin's borrowing costs have been lower than they would have been in normal times.He also underlined that Berlin has not always practised the fiscal discipline it is now preaching, having also broken the euro's deficit rules while German banks recklessly bought risky bonds.

The body cut its projections for growth across all OECD or developed countries from 2.3 percent in its last report to 1.6 percent in 2012, while EU states dropped in its estimations from two percent to 0.2 percent for next year.The group expects something of a recovery to 2.3 percent OECD-wide in 2013, but this would be a jobless recovery, with unemployment remaining at around eight percent for the next two years.Prospects only improve if decisive action is taken quickly, said the OECD's chief economist, Pier Carlo Padoan, upon the launch of the document.Padoan went on to call on eurozone leaders to take decisive action to prevent the worst, notably a strengthening of the region’s rescue fund and the use of the European Central Bank as lender of last resort to troubled states.In the euro area, the risk of contagion needs to be stemmed through a substantial increase in the capacity of the European Financial Stability Fund, together with a greater ability to call on the European Central Bank’s balance sheet.Much greater firepower must be accompanied by governance reforms to offset the risk of moral hazard, he said, in language that appeared to endorse more centralised fiscal-policy-making in the single currency area.
