Dear Constituents,
Hundreds of thousands of other Canadian citizens and residents who have past ties to the U.S. continue to grapple with the situation of filing Internal Revenue Service (IRS) tax returns and Report of Foreign Bank and Financial Accounts (FBAR).
The IRS recognizes the issue and states that its purpose is to bring Americans abroad into compliance.
On June 26, 2012, the IRS announced efforts to help U.S. Citizens living overseas, including dual citizens living in Canada and those with Canadian Registered Retirement Savings Accounts, catch up with filing their U.S. federal income tax returns or Reports of FBARs and comply with the law without facing penalties or enforcement action.
The new procedures will be effective as of September 1st, 2012.
The IRS memo dated June 26, 2012 provides new procedures and requirements that will allow taxpayers who are at low compliance risk to get up to date with their tax requirements without facing penalties or additional enforcement action.
Absent high risk factors, if the submitted returns and application show less than $1,500 in U.S. tax due in each of the years, they will be treated as low risk.
However, submissions that present higher compliance risk are not eligible for the procedure and will be subject to a more thorough review and possibly a full examination, which in some cases may include more than three years.
The IRS also announced that the new procedures will allow retroactive resolution of certain issues related to certain foreign retirement plans, mentioning specifically Canadian Registered Retirement Savings Plans.

FBAR Law Overview

  1. The Report of Foreign Bank and Financial Accounts, TD F 90–22.1, (FBAR), is required when a U.S. Person has a financial interest in or signature authority over one or more foreign financial accounts with an aggregate value greater than $10,000. If a report is required, certain records must also be kept.
  2. In April 2003, the IRS was delegated civil enforcement authority for the FBAR.
  3. IRM 4.26.16covers FBAR law. FBAR procedures are covered in IRM 4.26.17.

FBAR Statutory Authority

  1. Statutory authority for the FBAR is 31 U.S.C. § 5314.
  2. Section 5314 directs the Secretary of the Treasury to require a resident or citizen of the United States, or a person in and doing business in the United States, to keep records and/or file reports when making transactions or maintaining a relationship with a foreign financial agency.
  3. 31 U.S.C. § 5321(a)(5) establishes civil penalties for violations of the FBAR reporting and recordkeeping requirements. See IRM 4.26.16.4 FBAR Penalties for a discussion of penalties.

FBAR Regulatory Authority

  1. Regulatory authority for the FBAR is 31 C.F.R. §§ 103.24 and 103.27. Section 103.32 provides for FBAR records and Section 103.56 tasks the IRS with FBAR enforcement. Section 103.24 states that each person subject to the jurisdiction of the United States (except a foreign subsidiary of a U.S. person) who has a financial interest in, or signature or other authority over, a bank, securities, or other financial account in a foreign country must report that relationship to the Commissioner of the Internal Revenue for each year in which the relationship exists. The U.S. person must provide information as specified in the required reporting form.
  2. The FBAR must be filed on or before June 30 for foreign financial accounts aggregating more than $10,000 in the previous calendar year. 31 C.F.R. § 103.27(c)
  3. Any person required to file the FBAR must keep certain records of the account for five years. Records may need to be maintained for a longer period by persons who have been formally charged with a criminal tax violation. 31 C.F.R. § 103.32
  4. The authority to enforce the provisions of 31 U.S.C. § 5314 and 31 C.F.R. §§103.24 and 103.32 has been re-delegated from the Financial Crimes Enforcement Network (FinCEN) to the Commissioner of the Internal Revenue Service by a Memorandum of Understanding (MOU) between FinCEN and IRS. The MOU is referenced in 31 C.F.R. § 103.56(g). This includes authority to:
    1. Investigate possible civil violations of these provisions;
    2. Assess and collect civil FBAR penalties;
    3. Employ the summons power of subpart F of part 103;
    4. Issue administrative rulings under subpart G of part 103; and,
    5. Take any other action reasonably necessary for the enforcement of these and related provisions, including pursuit of injunctions.

FBAR Instructional Authority

  1. The instructions for the FBAR provide additional guidance and contain some rules not found in the FBAR statute or regulations. For example, the instructions identify exceptions to the filing requirement for certain corporate officers and employees having signature or other authority over a foreign financial account.
  2. The instructions in some instances are clarified by reference to the regulations. For example, terms in the instructions such as " United States" are defined in the regulations.

FBAR Filing Criteria

  1. In order to determine whether or not the FBAR is required, all of the following must apply:
    1. The filer is a U.S. person;
    2. The U.S. person has a financial account(s);
    3. The financial account is in a foreign country;
    4. The U.S. person has a financial interest in the account or signature or other authority over the foreign financial account; and,
    5. The aggregate amount(s) in the account(s) valued in dollars exceed $10,000 at any time during the calendar year.

U.S. Person

A U.S. person is defined by reference to three sources. 31 U.S.C. 5314 and 31 C.F.R. 103.24 identify persons who may be subject to the FBAR reporting requirement. The FBAR instructions identify a smaller group of persons who must file FBARs than could have been required, under the statute and regulations, to file.
  1. "The Secretary of the Treasury shall require a resident or citizen of the United States or a person in, and doing business in, the United States, to keep records, file reports..." and that " The Secretary may prescribe a reasonable classification of persons subject to or exempt from a requirement under this section or a regulation under this section" . 31 U.S.C. § 5314
  2. Each person subject to the jurisdiction of the United States (except a foreign subsidiary of a U.S. person)…shall provide information specified in a reporting form prescribed by the Secretary. 31 C.F.R. § 103.24
  3. The instructions to the July 2000 FBAR (the current version) define "United States person" as "a citizen or resident of the United States, a domestic partnership, a domestic corporation or a domestic estate or trust."
  4. "United States" includes the states, territories, and possessions of the United States. 31 C.F.R. 133.11(nn)
  5. Examiners should use the definition of "United States person " found in the FBAR instructions when determining whether a person has an obligation to file the FBAR.

Barack Obama’s singular claim to foreign policy success is based on his accounts of the events in which heroic Navy SEALS engaged Osama bin Laden in a fire fight which cost the brutal terrorist his life in May, 2011.
According to liberal purveyors of the Barack Obama foreign policy success myth, Obama’s vaunted “kill” of Osama bin Laden should supersede the president’s numerous gaffes and naïve foolishness in foreign policy, including his inaction during the Arab spring, his leading from behind efforts in dealing with Libya, the still-volatile and unresolved pursuit of nuclear capabilities by Iran, the mass murders of innocents by the Syrian government, and America’s “muted” voice as described by former Secretary of State Condelezza Rice in addressing the RNC convention.
None of that matters, according to Obama sycophants because the president “got” Osama bin Laden and still has the multi-spiked football to prove it! However, as reported, the Obama account of the kill has been challenged by a real hero—a Navy Seal, who was THERE!
Several news outlets have finally got their hands on a copy of the new book about the raid on Osama bin Laden’s Pakistan compound, and the details emerging contradict many of the earlier reports about what happened inside the house on the night the al Qaeda leader was killed. No Easy Day is set to be released September 11, but The Huffington Post’s Marcus Baram picked up a preview copy in a used bookstore, which is a common way to find pre-released books. The Associated Press bought a copy as well.The book, written by ex-Navy SEAL Matt Bissonnette (under the pseudonym Mark Owen), is a first-person account of the raid on the Abbottabad compound where bin Laden had been in hiding for years. According Bissonnette’s version of events, there was no extended firefight between SEAL Team 6 members and bodyguards and bin Laden himself never got the chance to confront or even see the soldiers before they killed him. Instead, he was shot in the hallway outside of his bedroom, then “disappeared into the dark room.” By the time the soldiers entered, he was already dying of wounds to the head. Bissonnette says he and another team member then shot him several more times in the chest to ensure he was dead.The book also says that while there were two guns found in bin Laden’s room, neither was loaded and he never had a chance to defend himself. Bissonnette even calls him a “pussy” for not being prepared to defend or kill himself. Even though bin Laden was killed without resisting, the SEALs were instructed beforehand that it was not an assassination mission and that bin Laden should have been brought back alive, if possible.Bissonnette is also critical of President Obama in his story, saying that no one on the team was a fan of the president and that they believed he and other leaders would inflate their own roles in the story. Even before the raid began, the SEALs joked about how they would help Obama get re-elected and also speculated about who would play them in the Hollywood movie. Despite their personal feelings about Obama, however, the SEALs did agree that he made the right call, saying “Although we applauded the decision-making in this case, there was no doubt in anybody’s mind that he would take all the political credit for this too.”
They also complained that after a White House meeting with Obama and Vice President Joe Biden (“he reminded me of someone’s drunken uncle at Christmas dinner”) the President invited them to return some other time for a beer, but that call never came.”
So much for the Obama success!
As with the Summer of Recovery which has been touted for the past three years but which has never been reflected in improved employment numbers, the economic stimulus which stimulated nothing but the national deficit, the Affordable Care Act which is ruining the best health care system in the world, and other foibles of the Obama legacy, the foreign policy success of the 44th president is sheer political spin.

IAF aircraft struck two centers of terrorist activity in northern Gaza on Friday night, the IDF Spokesperson's Unit reported.The statement said that direct hits were identified and all aircraft returned safely to their bases.
The attack came in response to high trajectory fire into Israeli territory, said the statement."The IDF will not tolerate any attempt to harm Israeli citizens and IDF soldiers and will continue to operate against anyone who uses terror against Israel," said the statement, adding that the "Hamas terrorist organization" is responsible for any terror activities which are launched from Gaza.On Friday morning, a rocket fired by terrorists from Gaza hit a home in the city of Sderot. One woman suffered from shock and the home sustained minor damage.
A second rocket exploded in an open area of the Shaar HaNegev Regional Council.On Thursday evening, a rocket launched by terrorists in Gaza exploded in an open area of the Ashkelon Coast Council region.
There were no reports of physical injuries or damage.Sderot has been a target for rocket attacks several times this week. On Monday morning, Gaza terrorists fired a Kassam rocket on the Sderot area, minutes after students arrived at their classes for the first day of school.The rocket exploded in an open area, reducing injuries to shock and trauma.Later in the day, Gaza terrorists fired two more Kassam rockets as children were returning home from their first day at school.The short-range missiles exploded in open areas and caused no damage or physicalinjuries.On Sunday morning, Gaza terrorists fired three Kassam rockets on the Western Negev, one of them damaging a building in the industrial area near Sderot. Palestinian Authority Chairman Mahmoud Abbas asked Iranian President Mahmoud Ahmadinejad to help establish a Palestinian state along the pre-1967 borders, PLO negotiator Saeb Erekat said Friday.
The Bethlehem-based Ma’an news agency reported that Abbas and Ahmadinejad met in Tehran on Thursday for what Erekat described as “frank and productive” talks.Erekat told Ma’an that Abbas had indicated to Ahmadinejad that the “Palestinian” diplomatic quest was to establish a state along the pre-1967 borders with Jerusalem as its capital.Abbas said that the mission had been approved by both the Arab Peace Initiative and the foreign affairs summit in Tehran in 2003.Ahmadinejad called on Abbas to implement reconciliation between his Fatah party and Hamas immediately, Ereket told Ma’an, adding that Abbas reassured the Iranian leader that national unity was his “top priority.”The PA recently announced its intention to turn to the UN General Assembly for recognition as a state.In September 2011, Abbas applied for full UN membership at the UN Security Council. Israel and the U.S. staunchly opposed the bid, which failed due to a lack of support in the 15-member council.Abbas’ meeting with Ahmadinejad took place on the sidelines of the summit of the 120-nation Non-Aligned Movement. Earlier this week, he threatened to pull out after Hamas’s Prime Minister in Gaza, Ismail Haniyeh, announced he had also received an invitation to the summit.Haniyeh later pulled out of the trip, citing a desire not to damage reconciliation efforts. Sources told Ma'an that the debacle started when Supreme Leader Ali Khamenei invited Haniyeh, while Abbas was invited officially by Ahmadinejad.Erekat told Ma’an that Abbas reassured Ahmadinejad that neither the PLO nor the Palestinian Authority objected to Iran or any other country inviting Hamas leaders to visit.
However, Abbas said that inviting Haniyeh to the Non-Aligned Movement summit without consulting the PLO was considered a snub to the legitimacy of the PLO as the sole representative of the Palestinian people.

A senior Egyptian security official said on Thursday that the balance of military power in the Middle East will change significantly in the near future, following a visit by President Mohammed Morsi in China this week.
The official, who spoke to the Arab website Al-Moheet, said that during his visit to China, Morsi signed a series of security agreements which will produce a new military reality in the Middle East. The comments were translated by Arab affairs expert Dalit Halevi.“Wait and see the Eagles of Egypt in their new clothing,” the official warned Egypt’s neighboring countries. “They will be protected by missiles which will hit our enemies, even if they are a thousand miles away.”The Egyptian Air Force, said the official, is expected to dramatically upgrade its capabilities, equipment, aircraft and personnel training, in cooperation with China. He said the upgrade will surprise all parties in the Middle East and North Africa. The Egyptian air defense forces will be able defend the Egyptians against any aggression, he said.Egypt launched a crackdown on Sinai terrorism in response to a recent attack on Egyptian officers. Egyptian police last week said they had identified 120 individuals in North Sinai who are wanted for attacking police stations and killing policemen. A security source in the area said that there are close to 1,600 terrorists in the area.Israel reportedly became concerned after Egypt moved anti-aircraft missiles into the Sinai Peninsula without Israel’s permission. Such equipment is prohibited in Sinai by the Egypt-Israel peace treaty.An Egyptian military source later denied that his country was deploying troops in Sinai beyond the limitations stipulated in the 1979 Camp David Accords.
Morsi hinted this week that his country's military operation in Sinai is being carried out in a way that fully honors international agreements.Morsi said that Egypt threatens no one, and that its forces' presence in Sinai should not be a cause for concern on the regional or international levels.He also said that the peace treaty with Israel will remain intact, but refrained from saying whether he would agree to meet any Israeli leaders.

Egypt says Syria's "oppressive regime" must go

DUBAI/AMMAN (Reuters) - Egypt called on Thursday for intervention to halt bloodshed in Syria, telling a meeting of 120 nations it was their duty to stand against the "oppressive regime" of Bashar al-Assad, prompting a Syrian walkout.President Mohamed Mursi, elected two months ago after a popular uprising toppled Egypt's long-standing leader Hosni Mubarak, said Assad had lost legitimacy in his fight to crush a 17-month-old revolt in which 20,000 people have been killed.Mursi's scathing speech to a summit of non-aligned leaders, hosted by Assad's Shi'ite ally Iran, prompted Syria's foreign minister to accuse the moderate Sunni Islamist leader of inciting further bloodshed in Syria.The political broadside against the Syrian president came as rebels said they shot down a fighter plane in northern Syria, where his air force has been bombarding opposition-held towns in a fierce counter-offensive against insurgents.It was the latest strike by Assad's foes on the air power he has increasingly relied on to crush the uprising. Rebels said this week they attacked a northern military air base and shot down a helicopter that was bombarding a district of Damascus."The bloodshed in Syria is our responsibility on all our shoulders and we have to know that the bloodshed cannot stop without effective interference from all of us," Mursi said."We all have to announce our full solidarity with the struggle of those seeking freedom and justice in Syria, and translate this sympathy into a clear political vision that supports a peaceful transition to a democratic system of rule that reflects the demands of the Syrian people for freedom."His comments prompted Syria's Foreign Minister Walid al-Moualem to storm out of the meeting, complaining that Mursi was inciting fighters to "continue shedding Syrian blood", Syrian state television said.
ASSAD SAYS NEEDS TIME
Assad, in his first television interview since rebels took their fight into the heart of Damascus and the country's biggest city, Aleppo, said on Wednesday his fight to put down the uprising was going well but needed more time."Everyone wants this battle to be completed in days or weeks but this isn't reasonable, because we are in the middle of a regional and international struggle and it needs time to be resolved," he said.Mainly peaceful protests were met with force by Assad's military, and the uprising has degenerated into a civil war with sectarian overtones and regional dimensions. The mainly Sunni Muslim rebels are backed by regional Sunni powers, particularly Gulf Arab states and Turkey.Assad, whose Alawite community is an offshoot of Shi'ite Islam, has support from Iran, a rival of Gulf Arab states and Western powers. Lebanon's Shi'ite militia Hezbollah has also shown solidarity with the Syrian president.The role of regional powers has assumed greater significance because of deadlock at U.N. Security Council, where diplomatic stalemate has marginalized the major powers.U.S., Russian and Chinese ministers are not expected to attend Thursday's U.N. Security Council meeting on Syria, underlining the fact that both Assad's critics and backers on the council see little prospect of it taking any action."We wanted a resolution on humanitarian issues, but we faced a double refusal," said a French diplomat, whose country will chair the meeting in New York.
"The United States and Britain believe we have reached the end of what can be achieved at the Security Council, and Moscow and Beijing said that such a resolution would have been biased."Nearly a year and a half after the uprising erupted, Assad's political foes are equally divided.A member of the Syrian National Council, which once hoped to win international endorsement as the country's leadership-in-waiting, resigned this week complaining it was not doing enough to back the revolt and must be replaced by a new political authority."My sense was that the SNC was not up to facing the increasing challenges on the ground," Basma Kodmani, the latest council member to break from the SNC, told Reuters.
PLANE "SHOT DOWN"
The Syrian Martyrs Brigade said on Thursday it brought down a plane near the town of al-Thayabiya. Video footage on Al Arabiya television showed what appeared to be smoke in the sky and a person parachuting down. An army helicopter hovered over the area, apparently in search of the pilot."The brigade has started targeting the regime's air assets, including military airports," a member of the group said from Idlib, declining to give further details.As well as targeting rebels, Assad's jets and artillery have also struck at least 10 bakeries in Aleppo province in the last three weeks, killing dozens of people as they waited in line to buy bread, the U.S.-based Human Rights Watch said.It said the attacks were either deliberate or done without care to avoid the hundreds of civilians forced to queue outside a dwindling number of bakeries in Syria's biggest city, a front line in the civil war.One attack two weeks ago killed around 60 people and wounded more than 70, it said.The fighting around Aleppo, Damascus and the southern province of Deraa, where protests against Assad first erupted in March 2011, has prompted waves of refugees to flood into neighboring Turkey and Jordan.Turkey urged the United Nations to protect displaced Syrians inside their own country, to take the pressure off its crowded refugee camps, and France said it was studying the issue of buffer zones in Syria, an idea Assad dismissed as unrealistic.(Additional reporting by John Irish at the United Nations, Erika Solomon in Beirut, Marcus George in Dubai; Writing by Dominic Evans; Editing by Jon Boyle)

U.S.-Israeli military exercise to be smaller than first planned

WASHINGTON (Reuters) - A U.S.-Israeli ballistic missile exercise postponed until this autumn will involve fewer U.S. military personnel than initially planned, the Pentagon said on Friday, but it rejected a media report portraying the decision as a sign of U.S. mistrust.The exercise is being planned amid rising war talk in the Israeli media and reports that Prime Minister Benjamin Netanyahu and Defense Minister Ehud Barak are debating a unilateral attack on Iran to knock out its nuclear installations. Washington has cautioned Israel against going it alone."Austere Challenge-12 remains the largest-ever ballistic missile defense exercise between our nations and a significant increase from the previous event in 2009," said Air Force Lieutenant Colonel Jack Miller, a Pentagon spokesman."The exercise has not changed in scope and will include the same types of systems as planned. All deployed systems will be fully operational with associated operators," Miller said.Time magazine reported on Friday that initially about 5,000 U.S. troops were planned to be involved in Austere Challenge-12 but that the number was being pared back to between 1,500 and 1,200. Former U.S. Ambassador to the UN, John Bolton, said in an interview published Friday that he does not believe President Barack Obama will order an attack on Iran, now or in the future, and urged Israel to attack Iran's nuclear program on its own.Speaking to Maariv's Tzach Yoked, Bolton said that "there is no way at this stage to prevent Iran from going nuclear without use of force. It is very unfortunate in my opinion, but I see no possibility that Obama will use military force, and therefore it falls upon Israel. I think that even though the Administration says that containment is not its policy, it will become its policy the day after Iran possesses nuclear weapons. They won't like it, but they do believe that a nuclear Iran can be contained, just as we contained the nuclear Soviet Union during the Cold War.""Iran is not in a race for building one or two bombs," Bolton continued. "I think they believe that time is on their side and they will continue with what seems like a well thought-out plan, mostly because they believe that the United States under Obama's leadership will do nothing. And of course, they are afraid of Israel, but I think they trust Obama to pressure Israel not to do anything, and until now this has proved right.""I think Israel, like any other country, has a legitimate right to self defense," Bolton told Maariv. EU commission gears up for banking union legislation

BRUSSELS - Legislation to establish a banking union for the eurozone will be tabled on 12 September, European Commission President Jose Barroso said in a speech Thursday (30 August).Speaking at the Aspbach Economic Symposium in Austria, President Barroso described the step, which is expected to see the Frankfurt-based European Central Bank given extensive powers to supervise and intervene in the European banking system, as "the next concrete and immediate deliverable of our vision to generate confidence in the future of the euro area". However, with Britain and other non-eurozone countries likely to opt-out of the system, the union is expected to focus on the single currency areas.At a news briefing in Brussels, Commission spokeswoman Pia Hansen confirmed that "the banking union will be for the seventeen," although she added that it would be open to non-eurozone countries. There would be "an interface for those who would like to join that supervisory mechanism," she said.The banking union launch had been pencilled in for 11 September but has now been pushed back by a day, allowing Barroso to unveil the plans in his annual State of the Union speech to the European Parliament in Strasbourg.Tentative agreement  on establishing a federal banking union was reached at the June EU summit, as political leaders seek to break the link between Europe's debt-laden banks and sovereigns. In June Spain was forced to request a bail-out package of up to €100billion to prop up its domestic banks which accumulated bad debts totalling an estimated €60 billion after the collapse of the country's property market. Meanwhile, high street banks in Germany and France are exposed to billions of euros in crisis-hit Italy, Greece and Ireland.
However, the passage of the legislation is far from clear. Germany's Angela Merkel has come under domestic pressure from her own CDU party and from Jens Wiedmann, the President of the Bundesbank, to block an expansion of powers for the ECB. On Monday (27 August) Wiedmann attacked the ECB's bond-buying programme, telling Der Spiegal that it amounted to "state financing via the printing press". Fellow Bundesbank executive member Andrea Dombret insisted that giving supervisory powers to the ECB would create "conflicts of interest."Despite this, Merkel is expected to support centralised oversight control of the banking sector before allowing the EU bail-out fund, the European Stability Mechanism, to directly refinance weak banks. While the ECB is expected to be given the "prudential  supervision" powers included in the EU treaty, the London-based European Banking Authority is expected to keep its role of monitoring the compliance of European banks with EU financial regulation.The Commission chief also revealed plans to overhaul the EU's Single Market legislation commenting that the Commission would prepare a "Single Market 2" in the coming weeks. Barroso said that the reforms would "build on the momentum" of the twelve bills making up the Single Market Act, currently being discussed by MEPs and governments.

China urges Germany and France to solve euro-crisis

BRUSSELS - Chinese Prime Minister Wen Jiabao on Thursday (30 August) offered vague promises to buy bonds from troubled euro-countries, but said that it is ultimately up to Germany and France to solve the crisis."The European debt crisis recently has continued to deteriorate, giving rise to serious concerns in the international community. Frankly, I am also worried," Wen said during a joint press conference with German Chancellor Angela Merkel.She had travelled to Beijing with half of her government for a joint session with the Chinese government, Germany being the only country with which China holds such meetings.
Despite her reassurances about "absolute political will" to save the euro, Wen expressed concern about the speed of the response.He pointed to the possibility of Spain and Italy also asking for bailouts as well as uncertainty regarding Greece's future in the eurozone. "The solution depends on the will and decisiveness of the big euro-countries, Germany and France, to help them out."China will continue to buy European bonds, Wen said, but he did not make any concrete pledges regarding Italy or Spain and noted that any purchases would require a full risk evaluation.Merkel said she wants Greece to remain in the eurozone and praised Italy and Spain for their reforms. "Both countries are on a very intensive reform path, which I am strongly convinced will bear fruits."The chancellor's display of power - it is the second time this year she meets with top Chinese officials and signs lucrative deals - such as an order for 50 Airbus planes worth €2.8 billion - is in stark contrast with the yearly EU-China summits which produce statements and pledges for cooperation.
A question about freedom of the press, with increasing restrictions by the Communist Party imposed on foreign correspondents, went unanswered by Wen. As for Merkel, she said: "We have a joint conviction that allowing for fair reporting is a basis for our nations to get to know each other better and to cooperate better."
She also played down a dispute over solar panels, with European producers calling on the EU commission to impose tariffs to punish the Chinese competitors for unfair subsidies received from Beijing."Protectionism cannot be the answer for certain difficulties, we have to try to solve existing problems by the way of talks, problems we have in the field of solar energy, for instance," Merkel said."We should endeavour to do so because there is still time and we will discuss with our colleagues in the European Union that we should give it a try."

EU in talks on more international emission deals

BRUSSELS - The EU is pressing ahead with talks on further bi-lateral carbon emissions agreements with a deal with Australia just announced.Isaac Valero-Ladron, spokesperson for EU Environment Commissioner Connie Hedegaard, said that talks on new bi-lateral deals on emissions trading were "underway with South Korea, China, Switzerland and California".The admission follows the announcement Tuesday (28 August) by Commissioner Hedegaard and Australian Climate Change minister Greg Combet of a bi-lateral deal that would create the world's largest emissions trading market if ratified.Under the deal, Australia, which at 27 tonnes per person is among the world's biggest carbon polluters per capita, will scrap its AUS $15 floor price (€12.5) intended for 2015, replacing it with EU prices which are currently being traded at between €8 and €9 per tonne.Australian businesses would have one-way access to EU carbon allowances to meet 50 percent of their carbon liabilities until 2018. Provided that agreement can be reached, the two markets would then be fully integrated from July 2018 allowing European and Australian firms to use up to 100 percent of each other's allowance.Hedegaard welcomed the deal as "the first full-intercontinental linking of emission trading system" adding that it would be "further evidence of strong international co-operation on climate change."The Commission is now seeking the backing of member states and MEPs to agree a formal trade treaty with Australia with a deadline of mid-2015. "We don't see why someone would be against more business opportunities for European companies in the carbon market, said Valero-Ladron.The passage of the treaty is likely to be tougher in Australia. With Labour Prime Minister Julia Gillard reliant on three Independent MPs for her parliamentary majority, the deal could face a difficult path in the federal parliament.
The deal has already come under attack from Tony Abbott, the leader of Australia's opposition Liberal party. Abbott, whose party opposed the Australian emissions trading scheme established in 2011 by the Labor government's Clean Energy Act, told reporters that brokering the deal was "wrong-headed" adding that "our traders...our competitors are not introducing this tax."Although Gillard's government has a parliament mandate to negotiate with the EU, the country's next federal elections are due in November 2013. With current opinion polls indicating victory for Abbott's Liberal/National coalition, the deal could yet be sunk before it starts.The EU Emissions Trading Scheme was launched in 2005 and will enter its 'Phase III' from January, which for the first time will involve an overall EU cap. If met, this would see a reduction in carbon emissions of almost 10 percent.

Isaac's remnants bring headaches but also relief to drought

NEW ORLEANS (Reuters) - The remnants of Hurricane Isaac continue to cause headaches on Friday, bringing heavy rainfall and the threat of flash flooding to the lower Mississippi Valley as Gulf Coast residents get ready to start their cleanup efforts.The first hurricane to hit the United States this year will be remembered for striking New Orleans on the anniversary of 2005's deadly Hurricane Katrina - and providing a first, successful test of the city's pricey new flood defenses.New Orleans Mayor Mitch Landrieu concluded that the ring of defenses was "operating as designed."Now a tropical depression, Isaac can still trigger tornadoes in Mississippi and Louisiana, the National Hurricane Center said - among the final acts of a storm that punched above its weight in terms of impact and often confounded forecasters.One bright spot: rain that is expected to reach the central U.S. Midwest over the weekend, a godsend to farmers suffering from the worst drought in more than 50 years, even if too late for many of this season's crops.Isaac caused widespread flooding and property damage in the U.S. Gulf Coast region, mostly because of its unexpectedly heavy and persistent rainfall. The system lingered near New Orleans for the best part of two days, sometimes moving as slowly as five miles an hour (8 km per hour)."Most of them blow through and are over with. Misery in La. as Isaac flooding leaves power out

NEW ORLEANS (AP) — Isaac sloshed northwards into the nation's midsection Friday after flooding stretches of Louisiana and knocking out power, leaving entire water-logged neighborhoods without lights, air conditioning or clean water.It will be a few days before the soupy brown water recedes and people forced out of flooded neighborhoods can return home.And the damage may not be done. Officials were pumping water from a reservoir to ease the pressure behind an Isaac-stressed dam in Mississippi on the Louisiana border. In Arkansas, power lines were downed and trees knocked over as Isaac moved north into the state.
The earthen dam on Lake Tangipahoa could unleash a 17-foot flood crest downstream in Louisiana if it were to give way, which prompted evacuations in small towns and rural areas Thursday. Officials released extra water through the dam and were considering punching a hole in it to lower the rain-swollen reservoir.
New Orleans, spared any major damage, lifted its curfew and returned to its usual liveliness, although it was dampened by heavy humidity."I have a battery-operated fan. This is the only thing keeping me going," said Rhyn Pate, a food services worker who sat under the eaves of a porch with other renters, making the best of the circumstances. "And a fly swatter to keep the bugs off me — and the most important thing, insect repellent."The heat was getting to Marguerite Boudreaux, 85, in Gretna, a suburb of New Orleans."I have a daughter who is an invalid and then my husband is 90 years old, so he's slowing down a lot," she said, red in the face as she stood in the doorway of her house, damp and musky from the lack of air conditioning.
Isaac dumped as much as 16 inches of rain in some areas, and about 500 people had to be rescued by boat or high-water vehicles.At least five deaths were reported in Louisiana and Mississippi.The latest two victims, a man and a woman, were discovered late Thursday in a home in the hard-hit town of Braithwaite, south of New Orleans. Authorities said deputies went to search for the couple after someone reported they had apparently not escaped the flooding. Their names were not immediately released.An unidentified man died in a restaurant blaze in Gretna that firefighters could not control because of Isaac's strong winds Wednesday. Another man died falling from a tree during the storm and a tow truck driver in Mississippi was killed when a tree crushed the cab of his truck.On Grand Isle, a barrier island on the Gulf, the town pumped away water. Sections of the only road to town had washed out.On a street turned river in Reserve, on the east bank of the Mississippi River, two young men ferried their neighbors to the highway in a johnboat, using boards as paddles.Lucien Chopin, 29, was last to leave his house, waiting until his wife and three kids, ages 7, 5 and 1 were safely away.He was finally joining them late Thursday, hoping they would find a shelter.His van was underwater and water flowed waist-high in the house he'd rented for eight months."It's like, everything is down the drain. I lost everything. I've gotta start all over."Chopin was upset that pumps meant to keep the area dry either failed or were shut off."We knew it was coming, but they didn't tell us we had to evacuate. We had no idea it was gonna be like this," he said, a refrain echoed by many.Cisco Gonzales, a heating and air conditioning business owner, said he got his boat and truck and headed for higher ground when he heard the water was rising quickly, from 0 to 6 feet of water in five minutes."I've never seen so much water in my life," said Gonzales, who built a home in Braithwaite, southeast of the city, after his previous home was damaged by Katrina in 2005.He rode out the storm at a ferry landing and when the weather calmed, he went out and rescued about a dozen people."I got back to my house to assess the situation, and it's a mess," he said. "That's all I can say."Isaac hit on the seventh anniversary of Katrina, a hurricane that devastated New Orleans.The two storms had little in common. Katrina came ashore as a Category 3 storm, while Isaac was a Category 1 at its peak. Katrina barreled into the state and quickly moved through. Isaac lingered across the landscape at less than 10 mph and wobbled constantly. Because of its sluggishness, Isaac dumped copious amounts of rain. Many people said more water inundated their homes during this storm than during Katrina.Both storms, however, caused the Mississippi River to flow backward. And both prompted criticism of government officials.In the case of Isaac, officials' calls for evacuations so long after the storm made landfall caused some consternation.Jefferson Parish Council President Chris Roberts said forecasters at the National Hurricane Center in Miami needed a new way of measuring the danger that goes beyond wind speed."The risk that a public official has is, people say, 'Aw, it's a Category 1 storm, and you guys are out there calling for mandatory evacuations,'" Roberts said.Eric Blake, a specialist at the hurricane center, said that although Isaac's cone shifted west as it zigzagged toward the Gulf Coast, forecasters accurately predicted its path, intensity and rainfall. He did say the storm came ashore somewhat slower than anticipated.
Blake cautioned against using Katrina as a benchmark for flooding during other storms."Every hurricane is different," Blake said. "If you're trying to use the last hurricane to gauge your storm surge risk, it's very dangerous."Crews intentionally breached a levee that was strained by Isaac's floodwaters in southeast Louisiana's Plaquemines Parish, which is outside the federal levee system. Aerial images showed the water gushing out.In Louisiana alone, the storm cut power to 901,000 homes and businesses, or about 47 percent of the state. That was down to 39 percent, or about 821,000, by Thursday evening, the Public Service Commission said.Entergy Corp., Louisiana's largest power company, said Isaac knocked out power to nearly 770,000 of its customers in Louisiana, Mississippi and Arkansas. Only three storms have left more customers without power: Hurricanes Katrina (1.1 million), Gustav (964,000) and Rita (800,000), the company said in a news release.More than 15,000 utility workers began restoring power to customers in Louisiana and Mississippi, but officials said it would be at least two days before power was fully restored.
In Mississippi, several coastal communities struggled with all the extra water, including Pascagoula, where a large portion of the city flooded and water blocked downtown intersections.High water also prevented more than 800 people from returning to their homes in Bay St. Louis, a small town that lost most of its business district to Katrina's storm surge.Robbie Daniel, 55, an industrial engineer, and his wife, Kathi, a retired school teacher, live in a house on the Tchoutacabouffa River in Biloxi, and hadn't left home since Tuesday. North Korea makes "significant" nuclear reactor progress: IAEA

VIENNA (Reuters) - North Korea has made significant progress in the construction of a light water atomic reactor over the past year, a U.N. watchdog report said, a facility that may extend Pyongyang's capacity to produce material for nuclear weapons.The International Atomic Energy Agency (IAEA), citing satellite images, also said "certain activities" had been observed at locations where the reclusive Asian state "reportedly" conducted nuclear tests in 2006 and 2009.But "without access to the locations the agency is unable to provide a technical assessment of the purpose of these activities or of whether nuclear material is being used," the annual report, issued to IAEA member states on Thursday, said.North Korea's nuclear program is a "matter of serious concern", it said, adding that the country's statements about uranium enrichment activities and the construction of the reactor "continue to be deeply troubling".North Korea says it needs nuclear power to provide electricity, but has also boasted of its nuclear deterrence capability and has traded nuclear technology with Syria, Libya and probably Myanmar and Pakistan. Iran doubles underground nuclear capacity: U.N. agency

VIENNA (Reuters) - Iran has doubled the number of uranium enrichment centrifuges it has in an underground bunker, a U.N. report said on Thursday, showing Tehran has continued to expand its nuclear program despite Western pressure and the threat of an Israeli attack.As Israeli politicians increased their talk of air strikes on Iran's nuclear sites in recent months, the Islamic Republic was rapidly increasing the enrichment capacity of its Fordow site, buried deep underground to withstand any such hit.The U.N. International Atomic Energy Agency also said in its quarterly report on Iran that buildings had been demolished and earth removed at a military site the IAEA wants to inspect, in what Western diplomats see as a determined effort by Tehran to clean up any evidence of illicit nuclear-linked tests.These "extensive activities" at the Parchin complex, the Vienna-based U.N. agency added, would significantly hamper its investigation there, if and when inspectors are allowed access.The building, which the IAEA believes is housing a steel chamber for explosives tests, has now been "shrouded", the report said, in a possible attempt to hide it from satellite cameras.In another apparent sign of stonewalling of the IAEA's inquiry, it said "no concrete results" had been achieved in a series of high-profile meetings with Iran this year aimed at allaying concern about its nuclear research."Iran's continued enrichment activities ... serve to taunt all those in the international community concerned by Iran's nuclear program," a senior Western diplomat said.In Washington, the White House said the United States had made it clear to Iran that it has a limited window of time to stop its nuclear activity and diplomatic terms offered by the West would not remain open indefinitely.
"We are closely studying the details of the report, but broadly speaking it is not surprising that Iran is continuing to violate its obligations," Press Secretary Jay Carney said.The IAEA said the number of centrifuges at Fordow, near the holy Shi'ite Muslim city of Qom, about 130 km (80 miles) from the capital Tehran, had more than doubled to 2,140 from 1,064 in May. The new machines were not yet operating, it said.Iran's supreme leader repeated this week that Iran's nuclear program was entirely peaceful. "Our motto is nuclear energy for all and nuclear weapons for none," Ayatollah Ali Khamenei told a developing nations summit in Tehran.But the expansion in enrichment infrastructure and the stockpiles of nuclear material revealed in the IAEA's report will do nothing to ease fears or reduce the diplomatic and sanctions pressure on Iran.
PARCHIN "LANDSCAPING"
The report may strengthen a belief in Israel - which sees Iran's nuclear program as an existential threat - that the West's tougher economic sanctions against Tehran this year are failing to make the major oil producer curb its program."This report corroborates what (Israeli Prime Minister Benjamin) Netanyahu has been saying for years now," an Israeli official said, referring to his view that the diplomatic process had only given Iran more time to pursue its program.Washington says there is still time for diplomatic pressure to work. It could be drawn into any Iran-Israeli conflict.Cliff Kupchan, a Middle East analyst at consultancy Eurasia Group, said he did not think the IAEA's findings represented a "game changer" and he believed any U.S. president would attack if there was an obvious Iranian bid to build a nuclear bomb.The IAEA said Iran had produced nearly 190 kg (418 pounds) of higher-grade enriched uranium since 2010, up from 145 kg in May, although a large part of that had been earmarked for conversion to reactor fuel. Refined uranium can have both civilian or military uses, depending on the enrichment level.Iran says it needs the higher-grade material - which is much purer than fuel needed for electricity generation - for a medical research reactor, but it also takes it significantly closer to making potential bomb material.Iran would need about 200-250 kg of uranium refined to 20 percent fissile concentration if it wanted to make one bomb, a decision it is not believed to have taken yet, experts say."Iran would not likely want to take the dramatic step of breaking out of the nuclear Nonproliferation Treaty (NPT) until it has enough material for several bombs — a point that it will not likely be able to reach for two years or more," said the Arms Control Association, a U.S. research and advocacy group.The IAEA expressed deepening concerns about Parchin, a military site southeast of Tehran that it wants to inspect for evidence of past nuclear weapons development tests. "Significant ground scraping and landscaping have been undertaken over an extensive area at and around the location," it said.

At least 25 shells fired by Syrian troops during the night struck a Lebanese Christian village on the northern border, wounding one person and causing damage, officials said.The border village of Minjez in the Akkar region was hit by at least 25 shells fired between midnight and 1:30 am on Friday (22:30 GMT Thursday), Toni Antonios, an elected official from the Christian community, told AFP, adding that a house was damaged.
A security official said a member of the security services was wounded by shrapnel."We have been the target for months of stray bullets and shelling which has displaced families who no longer dare go home. This is unacceptable," Antonios said."If they (Syrian troops) want to hunt down armed men, they must do it in their own land, not on our territory," he said, denying that Syrian rebels were in the village.The border has seen frequent exchanges of fire and the Syrian authorities have placed landmines along the frontier after accusing "terrorists" of infiltrating from Lebanon and groups there of supporting the rebellion by arming insurgents.
